hela Sverige The Legal Advisor works in the legal department of a Division or Business Unit and supports the bid process and projects in execution by assuming responsibility for all legal aspects from the Invitation To Tender (ITT) until the end of the warranty period.
YOUR ROLE
Offers support to Bids: pre-tender related work, pre-qualification support, drafting of pre-tender agreements, memorandum of understandings, analysis of ITT and support in Kick-off/Strategy Meeting;
Bid approval processes: summarizes, assess and recommend a position to be mandated on the important legal and contractual matters;
Interface to all other functions involved in the bid process as for example: Sales, Bid/Proposal Management, RAMS, Engineering, (Structured) Finance, Operations, Customer Support, Taxes, etc. for integration of their inputs in the contractual framework
Interface to Contracts department of other Divisions and to Group Contracts/Corporate
Responsible for contract negotiation in relation with customers (Rolling stock supply, Maintenance Contracts, Overhaul, Concessions Contracts), with suppliers (Procurement Contracts, Agency, Consultant & Representative Agreements) and with other stakeholders (Partnership agreements, Cooperation Agreements, Consortium Agreement, Shareholders and Joint Venture Agreements);
Assists Project Management, Procurement and Product Introduction in connection with contractual and legal issues with a view of maximizing opportunities and minimizing risks, throughout the life of a project and manages project-related litigation
Interdivisional Coordination (e.g. InterCompany Agreements between Divisions and/or between legal entities of the same Division);
Follow up, assist and coordinate claims, project and non-project related (litigations related to HR excepted);
Ensure proper governance and reporting of claims and litigations;
Ensures that the Contracts & Legal Affairs function fulfils its responsibilities in the applicable Policies and Directives, in lead or in support, as the case may be.
Education: University Law Degree (LLM);
Minimum 2 years of relevant experience;
Comprehensive understanding and good knowledge of legal and contractual areas that are relevant to the business;
Relevant experience in a practice-oriented and solution-focused organization requiring management of legal and commercial aspects;
English and Swedish at a business fluent level is mandatory.
