Volvo Group Intellectual Property is responsible for intellectual property for the entire Volvo Group and consists of three departments: Patents; IP Strategy & Portfolio; and IP Legal, Trademarks & Designs.
Due to expansion of our team, we are now recruiting a Patent Enforcement Attorney to Volvo Group IP; to be located at the Volvo Group's headquarters in Gothenburg. As a Patent Enforcement Attorney in the Volvo Group Intellectual Property department, you will be part of the team IP Legal, Trademarks & Designs; responsible for IP enforcement and defence work supporting the complete Volvo Group. This offers an incredible opportunity to work with a wide range of technologies, business areas, and people.
Your main focus will be handling patent enforcement and defence matters in close collaboration with other internal and external specialists. Your day to day work will also include managing other patent attorney tasks such as drafting, prosecution and post-grant proceedings before the patent offices in close collaboration with the other teams within the Volvo Group IP department; therefore practising the entire range of your professional skills.
You will report to Acting Group Director Volvo Group IP - IP Legal, Trademarks & Designs. The work will require travelling from time to time.
Main Tasks and Responsibilities
Your main tasks and responsibilities will be to:
• Day to day management of the patent enforcement operations, by setting up and managing global working groups with involved stakeholders on a project basis, together with a Legal Counsel IP
• Make risk and business assessments in relation to infringement-related matters, produce and collect evidence, participate and manage drafting of cease-and-desist letters, petitions and submissions to courts, participate in settlement negotiations, strategic litigation management, and manage external legal and technical experts in relation to the above
• Participate in and support the development, updates and fulfilment of internal strategic plans and directives in respect of IP enforcement, such as the annual Volvo Group IP Plan
• Render patent-related opinions, such as patentability, freedom to operate, and validity opinions
• Handle patent training, IP generation and invention harvesting workshops and provide advice and guidelines on inventions, invention disclosures and patent protection strategies
• Draft and prosecute patent applications and defend proprietary patents challenged by third parties in post-grant proceedings before the patent offices, and
• Manage external suppliers in connection with patent related-services and tasks, and verify quality of services and work products
Minimum Education and Experience
• Technical degree, such as Master of Science, equivalent or higher
• At least 5 years of experience working as a qualified Patent Attorney and/or European Patent Attorney or similar in industry or private practice, including expertise in patent application drafting and prosecution
• A qualified understanding of patent law and practice of major jurisdictions
• Practical experience of patent enforcement and defense work
• Practical experience of rendering patent-related opinions, e.g. patentability, freedom to operate, validity and infringement opinions
Critical Competencies and Skills
You have a strong personal credibility, integrity and a proactive can-do mindset with high drive, energy and are capable of performing multiple duties effectively in a fast paced environment.
This position requires deep knowledge and experience with patent law, and in particular in relation to patent enforcement. In addition, we expect you to have vast experience of representing before patent offices, as well as solid experience of dispute resolution and litigation.
Other pre-requisites for this position are distinctive problem-solving abilities, communication skills, together with cultural awareness and appreciation. You also need to be both a team player and take responsibility for working individually. The position requires business acumen, customer focus and entrepreneurial drive.
Good English communication skills, both oral and written are essential. Speaking Swedish is however not a prerequisite. A good understanding of the automotive business is a merit but not a requirement.
